Welcome to Coaching With Tanya. This website and the coaching services offered herein are owned and operated by Tanya Garcia, a Certified Wayfinder Life Coach operating in the State of North Carolina (hereafter referred to as "Coach," "we," "us," or "our").

By accessing or using this website, purchasing any coaching packages, or participating in our services, you (the "Client" or "User") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use this website or purchase our services.

1. Description of Services

We provide professional and personal coaching services, which may include one-on-one sessions, group sessions, digital resources, and email or message support (collectively, the "Services"). The specific details, scheduling, and duration of your coaching will be outlined in the package confirmation details provided at the time of your purchase.

2. Professional Disclaimer (Nature of the Relationship)

By using our website and services, you explicitly acknowledge and agree to the following:

  • No Medical or Psychological Advice: The coaching services, content, and materials found on this website are for educational, informational, and personal development purposes only. They are not a substitute for professional mental health care, psychotherapy, counseling, medical diagnosis, or medical treatment.

  • No Client-Therapist Relationship: The Coach is not acting as a licensed medical professional or mental health therapist.

  • Personal Responsibility: Coaching is a collaborative partnership, but you are solely responsible for your own physical, mental, and emotional well-being. Any choices, actions, or decisions you make based on coaching sessions or website content are strictly your own responsibility. We make no guarantees or warranties regarding specific outcomes, financial gains, or behavioral results.

3. Fees, Payments, and Refund Policy

  • Payment Terms: All fees for coaching packages, sessions, or digital products must be paid in full at the time of purchase, unless a formal installment plan has been explicitly agreed upon in writing.

  • Refund Policy: Because coaching requires a dedicated block of professional time and commitment, all sales are final. No refunds will be issued for completed sessions, unused portions of a coaching package, or termination of services mid-program, except as explicitly required by law.

4. Scheduling and Cancellation Policy

To respect both the Coach's schedule and other clients, we enforce a strict 24-hour cancellation policy:

  • Notice Required: You must provide at least twenty-four (24) hours' advance notice via email or our online scheduling platform if you need to cancel or reschedule a session.

  • Missed Sessions: If you fail to show up for a scheduled session or cancel with less than 24 hours' notice, that session will be forfeited, and no makeup session or refund will be provided.

5. Confidentiality & Privacy

We deeply respect your privacy. Any information shared during private coaching sessions or submitted through our website forms will be kept strictly confidential.

  • Exceptions: You acknowledge that a coach-client relationship is not protected by legal privilege (unlike an attorney-client dynamic). We may disclose your information without your consent only if required by a court order, or if we have a good-faith belief that disclosure is necessary to prevent imminent physical harm to you or someone else.

6. Intellectual Property Rights

All content published on this website and all materials, worksheets, frameworks, and exercises provided to you during your coaching are the exclusive intellectual property of the Coach.

  • You are granted a limited, non-exclusive, non-transferable license to use these materials solely for your personal growth.

  • You strictly agree not to copy, redistribute, sell, modify, or rebrand any website content or coaching materials for commercial use or public distribution.

7. Limitation of Liability

To the maximum extent permitted under North Carolina law, the Coach’s total liability for any claim, loss, damage, or injury arising out of your use of this website or our coaching services shall be strictly limited to the total amount actually paid by you to the Coach for the specific services in question. In no event shall the Coach be liable for any indirect, incidental, consequential, special, or punitive damages.

8. Governing Law and Dispute Resolution

  • Governing Law: These Terms of Service, your use of this website, and all services rendered shall be governed by, interpreted, and enforced in accordance with the laws of the State of North Carolina, without regard to conflict of law principles.

  • Mediation & Venue: In the event of a dispute that cannot be resolved through informal discussion, you agree to attempt to resolve the matter through formal mediation prior to filing any lawsuits. Any legal actions or proceedings must be filed and conducted exclusively in the state or federal courts located in North Carolina.
